Clear rules for using Mailtrackio responsibly

Acceptance of these Terms

These Terms of Service form an agreement between you and Mailtrackio concerning your access to and use of Mailtrackio websites, applications, dashboards, browser extensions, email-tracking tools, click reports, fill-and-sign features, and related services.

By creating an account, purchasing a plan, accessing the service, or otherwise using Mailtrackio, you agree to these Terms. If you use Mailtrackio for an organization, you represent that you have authority to bind that organization.

If you do not agree, do not access or use the service.

Eligibility and accounts

You must be legally capable of entering into a binding agreement and meet the minimum age required for online services in your location. Mailtrackio is intended for business and professional use.

• Provide accurate and current registration information.
• Keep login credentials confidential and use reasonable security measures.
• Do not share an individual account except where the plan and product allow authorized team use.
• Promptly notify Mailtrackio of suspected unauthorized access.
• Remain responsible for activity conducted through your account, except where prohibited by law.

The Mailtrackio service

Mailtrackio provides tools that may help users track email engagement, review link-click activity, organize recent events, request information, and manage fill-and-sign workflows.

Features, limits, supported browsers, integrations, storage, reporting, and availability may differ by plan and may change over time. The plan description, checkout page, order details, and in-product limits form part of these Terms.

Email tracking and lawful use

You may use email-tracking, click-reporting, and related features only for lawful purposes and in a way that respects recipients, applicable privacy rules, communications laws, contractual duties, industry obligations, and reasonable expectations.

You are responsible for:

• Determining whether tracking is permitted for your use case and recipients.
• Providing privacy notices and obtaining consent where required.
• Honoring recipient objections, opt-outs, and applicable rights.
• Using accurate sender information and lawful message content.
• Not treating a recorded event as definitive proof that a specific person read or intentionally clicked an email.

Mailtrackio may restrict tracking functionality or suspend an account when use creates legal, security, deliverability, reputational, or abuse concerns.

Prohibited conduct

You must not use Mailtrackio to:

• Violate law, regulation, court order, intellectual-property rights, privacy rights, or contractual restrictions.
• Send spam, phishing, fraudulent, deceptive, abusive, threatening, or unlawful messages.
• Track a person in a manner that is covert, unlawful, discriminatory, harassing, or inconsistent with required notice or consent.
• Upload malware, exploit vulnerabilities, disrupt systems, or bypass rate limits and security controls.
• Access another account, recipient data, or document without authorization.
• Reverse engineer, scrape, copy, resell, or commercially exploit the service except as expressly allowed.
• Use automated means that create unreasonable load or interfere with other users.
• Use the service for highly sensitive or regulated information unless Mailtrackio has expressly agreed in writing to support that use.
• Misrepresent Mailtrackio, impersonate another person, or conceal unlawful activity.

Fill-and-sign and electronic documents

Mailtrackio may enable users to create, send, complete, store, or download electronic document requests. You are responsible for the content, parties, fields, instructions, delivery addresses, and legal suitability of every request.

• Confirm that electronic signatures and records are suitable for the transaction and jurisdiction.
• Obtain authorization from document participants.
• Keep independent copies of documents that must be retained.
• Do not use the service for documents requiring a specialized process that Mailtrackio does not expressly support.

Mailtrackio does not provide legal advice and does not guarantee that a particular electronic signature, record, audit trail, or workflow will be legally sufficient for every purpose.

Customer content and permissions

You retain ownership of content you submit to Mailtrackio, including messages, recipient references, documents, form data, instructions, and account information, subject to any rights held by other parties.

You grant Mailtrackio and its service providers a limited right to host, process, transmit, reproduce, and display customer content as reasonably necessary to provide, secure, support, and improve the service and comply with law.

You represent that you have the rights and permissions needed to submit customer content and instruct Mailtrackio to process it.

Plans, fees, billing, and taxes

Some features require a paid plan. Prices, billing periods, feature limits, usage allowances, and renewal terms are shown during purchase or in the pricing dashboard.

• Fees are charged in the currency and on the schedule shown at checkout.
• You authorize the payment method to be charged for applicable fees, taxes, and renewals.
• Subscriptions may renew automatically until canceled, where stated during purchase.
• Usage above plan limits may be restricted, paused, or subject to additional charges when disclosed.
• Taxes, duties, and similar government charges may be added where applicable.

Except where required by law or expressly stated in a purchase offer, fees are non-refundable. Cancellation normally stops future renewal and does not retroactively refund a current billing period.

Trials, promotions, and lifetime offers

Mailtrackio may offer trials, discounts, promotional plans, or lifetime purchase options. The specific offer terms, limits, eligible features, updates, support level, account quantity, transferability, and availability shown during purchase control.

A promotional or lifetime offer does not guarantee that every future feature, integration, add-on, service, or increased usage limit will be included. Mailtrackio may discontinue an offer for new purchasers without changing completed purchases, subject to the applicable order terms and law.

Third-party services and integrations

Mailtrackio may connect with email providers, browsers, payment processors, storage providers, authentication services, or other third-party products. Third-party services are governed by their own terms and privacy practices.

Mailtrackio is not responsible for third-party changes, outages, data practices, content, or actions. An integration may stop working if a third party changes or withdraws access.

Mailtrackio intellectual property

Mailtrackio and its licensors retain all rights in the service, software, designs, interfaces, documentation, branding, trademarks, and other materials, excluding customer content.

Subject to these Terms and your plan, Mailtrackio grants you a limited, non-exclusive, non-transferable, revocable right to use the service for your internal business or professional purposes. No other rights are granted by implication.

Feedback

If you provide ideas, suggestions, or feedback, you grant Mailtrackio permission to use and incorporate that feedback without restriction or payment, provided Mailtrackio does not publicly identify you as the source without permission.

Suspension and termination

You may stop using Mailtrackio and may cancel a subscription through available account or billing controls.

Mailtrackio may suspend, restrict, or terminate access when reasonably necessary to address unpaid fees, security risk, suspected fraud, unlawful use, abuse, material breach, harm to recipients or third parties, excessive technical load, or legal requirements.

After termination, access to data may end. Export or download information you are required to retain before closing an account. Sections that by their nature should survive termination will continue to apply.

Service disclaimers

To the maximum extent permitted by law, Mailtrackio is provided on an “as is” and “as available” basis. Mailtrackio disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free or completely accurate results.

Mailtrackio does not guarantee email delivery, recipient action, legal validity of a transaction, business outcomes, uninterrupted access, permanent data storage, or compatibility with every device, browser, provider, or integration.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Mailtrackio and its affiliates, officers, employees, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, goodwill, or business opportunity; or the cost of substitute services.

To the maximum extent permitted by law, the total aggregate liability arising from or relating to the service will not exceed the amount you paid to Mailtrackio for the service during the twelve months before the event giving rise to the claim, or $100 if you used only a free service.

These limits do not apply where liability cannot be limited by law. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mailtrackio and its affiliates, officers, employees, suppliers, and licensors from claims, losses, damages, liabilities, and reasonable expenses arising from your customer content, your use of the service, your violation of these Terms, your infringement of another party’s rights, or your unlawful tracking, messaging, or document activity.

Governing law and disputes

These Terms are governed by the laws applicable to Mailtrackio’s principal place of business, without regard to conflict-of-laws rules, unless mandatory law requires otherwise.

Courts with jurisdiction over Mailtrackio’s principal place of business will have jurisdiction over disputes, subject to any mandatory consumer rights or other dispute procedures that apply. Before filing a formal claim, the parties should attempt in good faith to resolve the matter by contacting each other.

General provisions

• If a provision is unenforceable, the remaining provisions remain effective.
• A failure to enforce a provision is not a waiver.
• You may not assign these Terms without Mailtrackio’s consent; Mailtrackio may assign them as part of a reorganization, financing, merger, acquisition, or asset transfer.
• These Terms, the Privacy Policy, applicable order details, and incorporated policies form the agreement concerning the service.
• Headings are for convenience and do not limit interpretation.

Changes to the service or these Terms

Mailtrackio may update the service and these Terms to reflect product changes, security needs, business operations, legal requirements, or other developments.

The updated Terms will show a new effective date. Where required, Mailtrackio will provide additional notice of material changes. Continued use after the effective date constitutes acceptance to the extent permitted by law.
